Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the CourseFoundry website and related contact experiences (collectively, the “Site”). The Site is operated by CourseFoundry Learning LLC (“CourseFoundry,” “we,” “us,” or “our”) with a registered address at 1355 Market St, Suite 488, San Francisco, CA 94103, United States. 1. Acceptance of Terms

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.

You must be at least 16 years old to use the Site. If you are under the age of majority in your jurisdiction, you may use the Site only with the involvement and supervision of a parent or legal guardian who agrees to these Terms.

2. Educational and Professional-Use Disclaimer

CourseFoundry provides educational content and course information intended to support professional learning and workflow development. Materials shared through the Site (including syllabi, sample assignments, rubrics, and descriptions of teaching methods) are provided for informational purposes and do not constitute professional licensing advice, legal advice, or employment advice.

  • We do not guarantee job placement, hiring outcomes, promotions, client acquisition, or specific earnings.
  • Any examples of outcomes or metrics are illustrative and may vary based on attendance, revision cycles, baseline skill level, and external factors.
  • Some instructors, reviewers, or guest contributors may be independent specialists participating by invitation; their views may not represent the views of CourseFoundry Learning LLC.

3. Description of the Site and Services

The Site introduces CourseFoundry’s learning approach and provides a way to request course details via a contact form. The Site may include descriptions of course tracks, instructor bios, sample workflows, and operational information such as office location and contact methods.

The Site is provided “as is” and “as available.” We may modify, suspend, or discontinue any portion of the Site at any time, including changing content, course descriptions, and the availability of contact channels.

4. Acceptable Use

You agree to use the Site responsibly and lawfully. In particular, you agree not to:

  • Attempt to gain unauthorized access to the Site, servers, or related systems; probe, scan, or test the vulnerability of any system.
  • Use automated means to access the Site (including scraping, crawling, or harvesting content) except as permitted by robots.txt and standard browser behavior.
  • Submit false, misleading, or impersonated information through forms or communications.
  • Transmit malware, phishing content, or any code designed to interrupt, destroy, or limit the functionality of any system.
  • Interfere with or disrupt the Site, including by overloading, flooding, or mail-bombing any contact endpoints.
  • Use the Site in violation of applicable export controls, sanctions, or other laws.

We may suspend or block access if we reasonably believe your activity violates these Terms, threatens security, or compromises the integrity of the Site or other users.

5. User Submissions and Communications

When you submit information through a form, you represent that the information is accurate to the best of your knowledge and that you have the right to provide it. You also agree not to include sensitive personal data in free-text fields (for example, government IDs, financial account numbers, or health information).

We use submitted information to respond to your request and to provide course details. How we process personal data is described in our Privacy Policy. Cookie choices are managed through our Cookie Policy.

6. Intellectual Property

The Site and its content, including text, visual design, logos, page layout, course descriptions, rubrics, templates, and code, are owned by or licensed to CourseFoundry Learning LLC and are protected by intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Site for personal and internal informational use. You may not reproduce, modify, distribute, publicly display, create derivative works from, or exploit any part of the Site without our prior written consent.

7. Third-Party Services and Links

The Site may reference third-party tools that learners commonly use (for example, software required for a given track). Unless explicitly stated, such references are informational and do not constitute endorsements. We are not responsible for third-party websites, products, or services, including their availability, security, or privacy practices.

If the Site contains a link to a third-party service, you access it at your own risk and should review the third party’s terms and policies.

8. Disclaimer of Warranties

To the maximum extent permitted by law, CourseFoundry disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from a course of dealing or usage of trade.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any content will be accurate, complete, or current at all times. Content may be updated, corrected, or removed without notice.

9. Limitation of Liability

To the maximum extent permitted by law, CourseFoundry Learning LLC and its directors, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of (or inability to use) the Site, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the Site will not exceed the greater of (a) the amount you paid to us in the 12 months prior to the event giving rise to the claim, or (b) USD $100.

Some jurisdictions do not allow certain limitations of liability. In such cases, these limitations apply to the fullest extent permitted by applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless CourseFoundry Learning LLC and its affiliates, directors, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your submissions through the Site; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.

11. Force Majeure

We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, pandemics, power failures, internet or communications outages, cloud provider failures, or cyberattacks.

12. International Use

The Site is controlled and operated from the United States. We make no representation that the Site is appropriate or available for use in every jurisdiction. You are responsible for complying with local laws that may apply to your access or use of the Site.

13. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Subject to the dispute resolution section below, you agree that any legal action or proceeding arising under these Terms will be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction there.

If you are a consumer located in the European Union, you may have mandatory consumer rights under the laws of your country of residence. Nothing in these Terms limits those rights where applicable.

14. Dispute Resolution

Before filing a claim against CourseFoundry, you agree to try to resolve the dispute informally by contacting us at [email protected] with a brief description of the issue and the relief you seek. The parties will attempt to resolve the dispute for at least 30 days.

If informal resolution is not successful, disputes will be resolved in the courts described in Section 13, unless mandatory local consumer rules require a different forum.

For United States users, to the extent permitted by law, you and CourseFoundry agree that any dispute will be conducted on an individual basis. You agree not to participate in a class action, class arbitration, or representative action.

15. Termination

We may suspend or terminate your access to the Site at any time if we reasonably believe you have violated these Terms or if your activity creates security, legal, or operational risk. You may stop using the Site at any time.

The following sections survive termination: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Venue, and any other provisions that by their nature should survive.

16. Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and CourseFoundry regarding your use of the Site and supersede any prior or contemporaneous communications.

18. Assignment

CourseFoundry may assign these Terms, in whole or in part, to an affiliate or in connection with a merger, acquisition, corporate reorganization, or sale of assets. You may not assign or transfer these Terms without our prior written consent.

19. No Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to do so later. A waiver is effective only if in writing and signed by an authorized representative of CourseFoundry Learning LLC.

20. Modifications to These Terms

We may update these Terms from time to time. Changes become effective 14 days after the updated Terms are posted on this page, unless a shorter timeframe is required for legal compliance or security reasons. The “Last Updated” date above indicates the most recent revision.

21. Electronic Communications

By using the Site and contacting us electronically, you consent to receive communications from us electronically. You agree that all notices, disclosures, and communications provided electronically satisfy any legal requirement that such communications be in writing, to the extent permitted by applicable law.
